Last year, Arizonan’s chance to nullify the NDAA under SB 1182 passed both the house and senate, but was vetoed by a fearful Governor Jan Brewer.

That’s right, Arizonans and patriots around the country flooded the house, senate, and all their contacts with the information on the tyrannical NDAA, and courageously pushed its passage within the senate and house, only to be vetoed by Gov. Brewer, who was obviously fearful of slashes to funding and repercussions from the Feds.

This year, with continued help and action from the Tenth Amendment Center, Arizona has another chance to completely nullify the NDAA with HB 2573, just by contacting the same co-sponsors who passed the legislation last year.

The difference of course is that there is even more fire behind the push for NDAA Nullification, not just in Arizona, but around the country, especially with renewed threats against Gun Rights.

Additionally, the Tenth Amendment Center’s revision of the Liberty Preservation Act fits Gov. Brewer’s specified objections to SB 1182, now HB 2573, leaving her no scapegoat for vetoing a bill simply echoing the Bill of Rights.

NDAA Violates United States Constitution Article 1 Section 9 Clause 2:

NDAA denies right to Habeas Corpus, a writ by which an individual can be released from unlawful detention

NDAA Violates United States Constitution Article 3 Section 3: 

NDAA authorizes indefinite detention against Article 3 Section 3 which provides those charged with treason heightened due process protections

NDAA Violates United States Constitution Amendment 4:

NDAA Authorizes indefinite detention and before amended, authorized the detainment of citizens even after an Innocent verdict from a Jury, against the Fourth Amendment right to be free from unreasonable seuizeure

NDAA Violates United States Constitution Amendment 5:

NDAA Detainment provisions violate Amendment 5 right of prohibition of deprivations of liberty without due process

NDAA Violates United States Constitution Amendment 6: 

NDAA Detainment Provisions violate Amendment 6 right to a speedy public trial, ability to confront witnesses, knowledge of crime, and assistance of council

The NDAA clearly violates numerous sections of the Constitution, upon which all elected officials swear an Oath to protect and uphold. Additionally, the NDAA is just plain insane. In what country, but a tyrannical one, could the government ruling over a people declare the people subject to NO TRIAL, NO JURY, NO JUSTICE?

The innocent and the accused have a Right to a trial, a jury, and justice, for if it was only for the innocent, the State could declare anyone and everyone guilty, imprisoning them indefinitely, and rendering the title of innocent temporary and subject to totalitarians.

As written in the Tenth Amendment Center’s Arizona NDAA Nullification legislation, Federal agents and officials are prohibited from carrying out the provisions of the NDAA which declare Americans subject to indefinite detention, no trial, and no jury.

In addition, any Federal agents caught carrying out the legislation are to be reported and prevented from doing so by officials of the Arizona State government. This is not only a complete nullification of the NDAA’s Unconstitutional provisions, but a warning to those who seek to carry out a law that clearly violates the Constitution that their position within government will not prevent their arrest. You are not nobility, nor above the Individuals within this state and country.

Arizonan’s and patriots from around America should take this golden opportunity to not only put the Feds in their place, and thus affect the list of other Constitutional violations hurting Americans, but also to symbolically send a message that the Constitution, which simply enumerated the natural Rights of individuals within this country, will return to being the law of the land.

By nullifying the NDAA within Arizona, we will deliver more support to states that have already nullified this federal law, and states whose citizens are still subject to the Feds indefinitely detaining them without trial, without jury, and without justice.

The time for Arizonans and individuals around the country to stand up is now, and the tool of Nullification is a treasure left behind by the Founders of this country and countless Individuals who were subjected to the creation of laws without consent and without regards to the Natural Rights of the Individual.

Once again, the Tenth Amendment Center has courageously volunteered to fulfill the duty of retrieving the signatures; it is only calling upon individuals to convince their representatives in favor of NDAA Nullification, many of whom already voted and co-sponsored last year, and by the February 11th deadline.
